By now you have probably heard the news that Obama administration has ordered FBI agents to read Mrianda rights to captured terrorists.

When 9/11 mastermind Khalid Sheikh Mohammad was captured on March 1, 2003, he was not cooperative. “I’ll talk to you guys after I get to New York and see my lawyer,” he said, according to former CIA Director George Tenet.

Of course, KSM did not get a lawyer until months later, after his interrogation was completed, and Tenet says that the information the CIA obtained from him disrupted plots and saved lives. “I believe none of these successes would have happened if we had had to treat KSM like a white-collar criminal – read him his Miranda rights and get him a lawyer who surely would have insisted that his client simply shut up,” Tenet wrote in his memoirs.

If Tenet is right, it’s a good thing KSM was captured before Barack Obama became president. For, the Obama Justice Department has quietly ordered FBI agents to read Miranda rights to high value detainees captured and held at U.S. detention facilities in Afghanistan, according a senior Republican on the House Intelligence Committee. “The administration has decided to change the focus to law enforcement. Here’s the problem. You have foreign fighters who are targeting US troops today – foreign fighters who go to another country to kill Americans. We capture them…and they’re reading them their rights – Mirandizing these foreign fighters,” says Representative Mike Rogers, who recently met with military, intelligence and law enforcement officials on a fact-finding trip to Afghanistan.

And can you imagine… Congress was not briefed…

Rogers, a former FBI special agent and U.S. Army officer, says the Obama administration has not briefed Congress on the new policy. “I was a little surprised to find it taking place when I showed up because we hadn’t been briefed on it, I didn’t know about it. We’re still trying to get to the bottom of it, but it is clearly a part of this new global justice initiative.”

Can Obama be detained for aiding terrorists? This is absurd. Terrorists who are not talking, or being interrogated cannot provide us with information to prevent future terrorist attacks. It was no accident that we have not been attacked since 9/11. But Obama seems determined to make it harder for us to collect intelligence, and easier for terrorists to attack us.

It is worth noting that Obama himself claimed to oppose reading Miranda rights to terrorists. He said, ”Now, do these folks deserve miranda rights? Do they deserve to be treated like a shoplifter down the block? Of course not.” The Weekly Standard posts video of Obama on he campaign trail last year, mocking this claim made by Sarah Palin during the Republican National Convention:

“Al Qaida terrorists still plot to inflict catastrophic harm on America, and [Obama]’s worried that someone won’t read them their rights.”

Well, looks like Sarah Palin was right. Obama is a liar. Obama is more interested in protecting the so-called rights of terrorists than in protecting Americans. Obama is clearly unfit for office.

    Matt, this is not journalism. This is more republican echo-chambering. There isn’t even any proof that Obama HAS told anyone to read Miranda rights to anybody – just an “unnamed” source who happens to be in the party that would like to believe it was so.

    It’s obviously a slow news day for you on the right, while you try to pretend that right wing terrorism hasn’t struck yet again today.

    These are not rights. The declaration is a warning such that the accused’s right cannot be violated for speaking openly to law enforcement. This is a requirement in the United States. It is a political protection against future suits as well. There are no “Miranda rights” only Constitutional rights that protect citizen and non citizen alike in federal custody on US soil. This was done by someone with a strict constructionist view of the United Sates Constitution, so I am told.

    “There has been no policy change and nor blanket instruction issued for FBI agents to Mirandize detainees overseas. While there have been specific cases in which FBI agents have Mirandized suspects overseas, at both Bagram and in other situations, in order to preserve the quality of evidence obtained, there has been no overall policy change with respect to detainees.”

    In fact, if anyone is to be tried in a criminal court, they HAVE to be Mirandized, which could indeed be the incidents to which Dean Boyd is referring – but this is far from what Matt is claiming, that there has been a policy shift to it. In fact, he’s claiming that Obama is a liar because Sarah Palin was right about this, when in fact, Sarah Palin was incorrect on it and Matt is actually the one misrepresenting something dishonestly.

    “Miranda Rights” or more properly the Miranda Warnings which invoke privileges like habeas corpus and the right to remain silent are for American citizens accused of criminal activity within the boarders of the United States but hey, what the F* — let’s make it worldwide for folks who chop heads off without due process, kill innocent people in mass attacks and use the feeble minded to carry bombs. F*ing A…sounds about right for a progressive.

    First, Miranda Warnings are for criminal activity—not acts of war. Second, they apply to US Citizens, and legal aliens—not foreign fighters with no state or political statue and finally, I did my time and I am sure it would slow our troops down a great deal to have an attorney with each of them to read the warnings to anyone captured in a foreign battlefield; nevertheless, America wouldn’t weep too long if we lost a few attorneys but let’s start with those in congress that voted for this conflict. Since they are in power—Democrats first of course.

    Crap, just to save time and my folks—the attorney would be right behind the 2nd lieutenant as far as life expectancy.

    @Dbschmidt: If we’re going to try someone in a court of law in the US, the law says they are entitled to certain rights, and also says they are entitled to be informed of those rights. Now I know a lot of right wingers would prefer to let these people rot without any access to justice, because it doesn’t impact them directly – but America is a country of law and justice, and that means that even if it’s distasteful, the law applies to EVERYBODY.

  14. So, Mark, you support releasing vicious terrorists into the wild where they can plot more attacks on Americans? Because that’s what they’re trying to avoid by doing this. We already have (at least) one unprosecutable terrorist on our hands, Muhammad al-Qahtani, one of the would-be twentieth hijackers. Do you really want to compound the problem? I realize that you don’t want Obama to restore the rule of law in the first place, but since he is, you should at least be happy he’s going about it the right way.

    Does this mean that Von Brunn (who posted at FreeRepublic, BTW) should be tried in a secret military tribunal- since he would be a terrorist, or the shooter of Tillman- should he be waterboarded since he’s a terrorist? Or just if they’re Muslim or from another country?

    We are returning to the US Constitution after a long absence during the Bush era. During the Reagan era, Reagan called himself a “Global Citizen” and criticized those nations in which individuals would ‘disappear’ and be tried and tortured in secret. . . something the Bush administration engaged in.

    How is the open and equal application of justice for everyone against the US Constitution?

    Bush said “They hate us for our freedom” and then proceeded to take away that very freedom. . . Obama is restoring justice and the rule of law.

    Hard to make a distinction between ‘types’ of waterboarding. . . Even in SEER training, it is considered torture (the REASON they do it is an attempt to immunize the SEALS from torture tactics, in the Marine’s own words).

    The question is. . . if one of our soldiers was captured and the same techniques were applied to him/her, would we consider it torture? If waterboarded with over 100 ‘pours’ over a month, would you consider it torture (hint: just about everyone who has undergone it considers it torture, even those right-wing nutcases who didn’t previously, like Muller who lasted SIX SECONDS before changing his mind and deciding it was torture!)

    Hasn’t Sean Hannity publicly stated he would be waterboarded for charity? Why hasn’t he? Would his pretty-boy hair get too mussed up? I think Rush Limbaugh and Sean Hannity should do a PPV charity event to prove that waterboarding is not torture! It would get HUGE ratings, even if it lasted shorter than the Tyson-Spinks fight in 1988!

    My point is no matter one wants to believe these folks are not US citizens in jail for being accused of knocking over a bank–they are enemy combatants that were picked up on foreign soil and are not entitled to the rights and privileges of US citizens.

    Military tribunals is where they should all be tried and there is nothing secret about them. Then whatever sentence from acquitted to the death sentence should be carried out.

    None of them should ever have the privilege of stepping foot on US soil.

    And my question about detaining Petraeus is an exaggeration, too. Get the point now?     At any rate, Petraeus not only shot down the notion (that Matt, of course, tried to forward–that’s the aforementioned unfortunate ability of his coming into play) that there is a wholesale secret effort to Mirandize every single detainee, he also said that he isn’t at all bothered that some (not all) detainees were Mirandized by the FBI such that any testimony could be admissible in any future court proceedings.

    The question remains, then, why you are so bothered by it.
