So Friday was an interesting day. Julius Caesar or I mean President Obama decreed that illegal aliens between the ages of 18-30 I believe along with some other criteria, will no longer have to  worry about being deported and can obtain work visas. A noble idea to be sure, and one that would find little argument amongst conservatives, but the manner in which it was done is not only politically questionable but once again is legally questionable. Obama has a sworn duty to uphold the laws, and can not give orders to any federal agency to over look those laws, so once again Obama may find himself in court. But the bigger question is the political one, and there are plenty of those, justifiably. First of all, Obama had two years of a super Congressional majority during which he could have accomplished a lot, and actually did, much to mine, and many others chagrin, but failed to do anything about immigration reform which he had actually promised to do. Instead, he spent that time chasing the democrats holy grail of government run healthcare. That should tell the Hispanic community of where his priorities are, and this last minute bone he is throwing them is an actual insult in my opinion. Of course that is in stark contrast as to how the Obama sycophantic media is reporting it, according to them, this was a deft move that caught Romney off guard.

However this recent stunt by Obama is typical liberal – appeasing and assuaging the proletariat with feel good, do nothing policies that only serve to keep the masses wanting more. What needs to be done is serious reform, with compassionate measures such as this built in to the bill. In fact Marco Rubio is, or was, working on a very similar piece of legislation that he planned to introduce to the floor, you know the proper method of getting things done, until Obama delivered his sermon, so this is hardly an idea that will be fought. In fact, President Bush initiated reform legislation which was defeated mainly by conservatives because of the amnesty aspect, but there is common ground and their is a political will I believe on both sides of the aisle to get something done. A real leader would recognize and work wintin the system to get something meaningful, instead iwe get just a band aid on a gaping wound for our country and we will need serious people to resolve this problem – not some narcissistic, egomaniac looking to win an election.

    The President of the United States of America does hold constitutionally a limited legislative power. The types of this power are the ability of issue a proclamation, the ability to approve of or veto a bill and the power to issue an executive order to a federal agency.

    The Congress may seek to cancel an executive order by passing a bill in opposition to the EO. If the President vetoes that bill then it is up to the Congress to override that veto. This is not the only check to an executive order, however, the Supreme Court can take up the constitutionality of an EO as well.

      Are you saying that this power extends to overriding existing properly legislated law? Are you saying that this power allows the president to simply ignore or negate laws already in place?

      Please do expand upon your concept of the powers of the presidency, for two reasons. One, I would like to see what you think the nation should look like under a Liberal president with the powers you think he should have, and two, I would like to put your answer into an archive so I can go back to it when you freak out about President Romney issuing a proclamation or executive order you don’t like.

      GMB, you need to Google “checks and balances” my friend. You have a right to your opinion as I have a right to mine, but you don’t have the right to make up your own facts. The difference between conservatives and liberals is that liberals can accept the facts while conservatives would rather repeat a lie until it takes on the appearance of the truth.

        Please point out the “law” that allows one to selectively enforce or not enforce the laws of any county, State, or Federal at will. Come on Schwartz–being a lawyer and all should on on the tip of your forked tongue.

        The sad thing is, poor delusional Freddy probably believes this garbage. This is the kind of hateful crap fed to lemmings and dupes, to encourage their hate-based emotional lurches toward a system which rewards and validates this kind of delusion.

        Freddy seems quite blissfully unaware of the “facts” that Liberalism has never succeeded as a blueprint for governing a nation, has never resulted in anything but economic misery and loss of personal liberty, and is corrosive to the human spirit. Is there any indication that he has accepted these facts? Not that I have seen.

        But he has accepted the lie that Liberalism is the opposite of its reality, that it is the political model which frees the spirit of mankind, which provides equality and freedom and all that is good, only because this has been repeated so often to him. Just as he has evidently accepted oft-repeated lies about this “conservatism” which he finds so deeply offensive, without actually knowing a thing about it.

        The facts are there, but the Freddys of the Left refuse to look at them. There are ample records of the sordid histories of Leftism and its grim results when it has been applied, in nation after nation, but the Freddys of the world close their eyes, cover their ears, shout their LALALALALALALALALALAs to drown out efforts to tell them the truth, and persist in their Magical Thinking that This Time It Will Be Different.

        Freddy can’t even DEFINE conservatism, much less this “liberalism” which makes him so giddy. He just trundles around in his cab, listening to Ed Schultz and feeling smart because Ed tells him it is smart to believe what Ed tells him, and then he comes onto blogs like this one and regurgitates this spite and malice with such pride in his achievement.

        Where is the pride in working to undermine and destroy the best and brightest governmental system ever devised? What is the glory in attacking an established and functional political model, which has brought freedom and dignity and prosperity to hundreds and hundreds of millions of people for more than two centuries?

        How many people have died to get INTO any of the Liberal nations being governed by Leftist ideology? On the contrary, people have risked their lives to ESCAPE the very system Freddy is telling us is sooooooo superior.

        But its minders pat him on the head and tell him he is quite smart and brave, that his history of being shunned for his personality disorders is just because those nasty people were just “conservatives” and that nastiness and hostility and mindless attacks on others are really proof of his ability to discern the truth and his courage in attacking the designated enemy.

        He is just more intellectual cannon fodder, easily identified by the Left by the fact that he already lives in a fantasy world of demons, with an invented job and invented credentials. He has “dupe” written all over him.

      There is no provision in this document for the President to disregard any law of the land.

      If choosing Rubio as the VP would actually help Romney in the general he would already be the announced choice. I’ve heard the announcment will come after the London Olympics and before the convention in Tampa. There’s a part of me that would like to see another debacle like McCain picking Palin meaning Romney chooses Nikki haley but I know that the Romney handlers are smarter than the folks who wandered into that vast Alaskan desert four years ago.

    President Obama took the oath of office twice (Jan 20 in public, Jan 21, 2009 in private), and, IMHO, has spit on the laws of this country and Constitution ever since. The Marines also take an oath;

    “I, XXXXXXXXXX, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.”

    but even in the President’s two swearing of the oath contains as is protocol:
    “I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”
    which is specified in Article Two, Section One, Clause Eight.

    Please note in the Marines (Enlisted) oath is “obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice which means I do not have to follow unlawful orders as King Obama feels to strike or write that go against the Constitution or other laws of this nation. The Constitution and the law of the land be damned because he thinks it is a “good idea.” This is FDR trying to become a King all over again.

    Hoping that this President, his minions, and the rest of the progressives enjoy the dustbin of history shortly before this becomes more than just a “pissing contest” ~ nevertheless, I am almost on par with DHS and the Border Agents with my hording and rotation of ammo, ‘cept mine is all .44 Magnum.

      dbschmidt, just because you don’t agree with a law, or with an executive order issued by the President doesn’t make it an unlawful order. You have the option as an officer to resign your commission and as an enlisted man to report any order you deem unlawful to your superior NCOs. But you know that already.

        Last time I checked dbschmidt the average enlisted man wasn’t allowed by the UCMJ to determine what was and was not unconstitutional. Opinions don’t carry any weight in the military only orders.

        Once again wrong, as it is the duty of every enlisted and officer to determine whether the order that was issued was legal or not. Reporting is a secondary matter. Not according to their personal beliefs but by the UCMJ, the Constitution, and other applicable laws as determined by their current place of residence.

        For a supposed lawyer ~ you are really not that bright, Then again it was not an executive order in this case but that might be too much information for you at once.

        Any soldier in any army is under no obligation to obey an unlawful order. They are under no obligation to report an unlawful order to any superior. Pure fallacy. Interesting world you live in there.

        Schwartz, in reply to (explicit) the average enlisted man wasn’t allowed by the UCMJ to determine what was and was not unconstitutional. would not carry any weight if a superior officer or superior enlisted ordered me to shot you dead as a civilian although you appear to me as “no harm.” Even though there are 60 separate articles that speak about that very matter. Every Marine has to decide (we are that smart) to decide for ourselves. Additionally, we can evaluate orders passed done from upper ranks (in your perceived elitists think group) as I passed up the “opportunity” to mustang because I felt I was more valuable where I was..

        Just as I doubt I would bear fire against President Obama because he is (whether I like it or not) currently the Commander in Chief (among other things) and I respect the position. Nevertheless, make no mistake I do not respect the man and what he has brought on this country. I, personally, would not harm him in any manner because he was voted into that position (and their is the entire Biden thingee) ~ does not mean I have to kiss his ass.

    To the rabidly radical Left, all is malleable, all is flexible, all can be changed upon a whim. A law is not absolute, but merely a suggestion. Discrimination based on age is terrible unless it is directed at an inconvenient child, in which case capital punishment is OK—and for most Libs, the ONLY time it is OK.

    We do have immigration laws in this country, we have had legislation on matters of immigration and enforcement of those laws, and no president has the right to countermand a law or impose selective enforcement of a law.

    It would be bad enough if it was just a self-indulgent power play based on compassion. But it is a callous and calculated effort to win votes from a targeted demographic, which makes it worse than a mere overstep of presidential power.

    And to be lectured by self-described demons in hell, people so totally invested in their own delusions, posturing with invented credentials, claiming to be living in another country, is too funny. Freddy does love to present us with cliches as if he invented them himself, as he has invented his “job” and his “credentials” but all in all both he and the major pain are mere poseurs, childish fantasists living in a silly little bubble of make believe, and today they are pretending they know something about American politics.

    Actually, the way I heard it was: Gota Wasdini walked into a bar with the major pain sitting on his head. The barkeep said “What’s that on your head?” and Gota said “Damned if I know—it started off as a pimple on my butt”.

    (See how I got “damned” in there, an homage to the whole hell thing…. It was either that or “Beats the hell out of me….etc”)
